AllotMe’s Greenfinger's Refund Policy

 

 

These terms and conditions govern AllotMe’s policy for Greenfinger refunds (“Greenfinger Refund Policy”) and the obligations of the Host associated with the Greenfinger Refund Policy. The Greenfinger Refund Policy applies in addition to AllotMe’s Terms of Service (“AllotMe Terms”). The Greenfinger Refund Policy is available to Greenfingers who book and pay for a Plot through the AllotMe Platform and suffer a Mitigating Issue (as defined below). The Greenfinger’s rights under this Greenfinger Refund Policy will supersede the Host’s cancellation policy.

 

All capitalised terms shall have the meaning set forth in the AllotMe Terms or Payments Terms unless otherwise defined in this Greenfinger Refund Policy.

 

By using the AllotMe Platform as a Host or Greenfinger, you are indicating that you have read and that you understand and agree to be bound by this Greenfinger Refund Policy.

 

  1. Mitigating Issue

 

A “Mitigating Issue” means any one of the following:

(a) the Host of the Plot (i) cancels a booking shortly before the scheduled start of the booking, or (ii) fails to provide the Greenfinger with the reasonable ability to access the Plot (e.g. does not provide the keys and/or a security code and/or clear directions etc).

(b) the Listing’s description or depiction of the Plot is materially inaccurate with respect to:

• the size of the Plot (e.g., number of planting beds, area in m2),

• whether the booking for the Plot is for an entire Garden, private space or shared space, and whether another party, including the Host, will also be using part of the Plot during the booking,

• special amenities or features represented in the Listing are not provided or do not function, such as water outlets, gate access, storage facilities or garden tools (shovel / trowels etc), or

• the physical location of the Plot (proximity).

(c) at the start of the Greenfinger’s booking, the Plot: (i) is not generally clean and sanitary (ii) contains safety or health hazards that would be reasonably expected to adversely affect the Greenfinger’s stay at the Plot in AllotMe’s judgment, (iii) does not contain clean bedding and bathroom towels available for the Greenfinger’s use, or (iv) contains pets not disclosed in the Listing.

 

2. The Greenfinger Refund Policy

 

If you are a Greenfinger and suffer a Mitigating Issue, we agree, at our discretion, to either (i) reimburse you up to the amount paid by you through the AllotMe Platform (“Total Fees”) depending on the nature of the Mitigating Issue suffered, or (ii) use our reasonable efforts to find and book you another Plot for any unused nights left in your booking which is reasonably comparable to the Plot described in your original booking in terms of size, rooms, features and quality. All determinations of AllotMe with respect to the Greenfinger Refund Policy, including without limitation the size of any refund and the comparability of alternate Plots, shall be in AllotMe’s discretion, and final and binding on the Greenfingers and Hosts.

 

3. Conditions to Claim a Mitigating Issue

 

To submit a valid claim for a Mitigating Issue and receive the benefits with respect to your booking, you are required to meet each of the following conditions:

(a) you must be the Greenfinger that booked the Plot;

(b) you must bring the Mitigating Issue to our attention in writing or via telephone and provide us with information (including photographs or other evidence) about the Plot and the circumstances of the Mitigating Issue within 24 hours after the later of (i) the start of your booking or (ii) you discover the existence of the Mitigating Issue , and must respond to any requests by us for additional information or cooperation on the Mitigating Issue;

(c) you must not have directly or indirectly caused the Mitigating Issue (through your action, omission or negligence); and

(d) unless AllotMe advises you that the Mitigating Issue cannot be remediated, you must have used reasonable efforts to try to remedy the circumstances of the Mitigating Issue with the Host prior to making a claim for a Mitigating Issue.

 

4. Minimum Quality Standards, Host Responsibilities and Reimbursement to Greenfinger

 

4.1 If you are a Host, you are responsible for ensuring that the Plots you list on the AllotMe Platform meet minimum quality standards regarding access, adequacy of the Listing description, safety, cleanliness, and do not present a Greenfinger with Mitigating Issues. During a Greenfinger’s renting a Plot, Hosts should be available, or make a third-party available, in order to try, in good faith, to resolve any Greenfinger issues.

 

4.2 If you are a Host, and if (i) AllotMe determines that a Greenfinger has suffered a Mitigating Issue related to a Plot listed by you and (ii) AllotMe either reimburses that Greenfinger (up to their Total Fees) or provides an alternative Plot to the Greenfinger, you agree to reimburse AllotMe up to the amount paid by AllotMe within 30 days of AllotMe’s request. If the Greenfinger is relocated to an alternative Plot, you also agree to reimburse AllotMe for reasonable additional costs incurred to relocate the Greenfinger. You authorise AllotMe Payments to collect any amounts owed to AllotMe by reducing your Payout or as otherwise permitted pursuant to the Payments Terms.

 

4.3 As a Host, you understand that the rights of Greenfingers under this Greenfinger Refund Policy will supersede your selected cancellation policy. If you dispute the Mitigating Issue, you may notify us in writing or via telephone and provide us with information (including photographs or other evidence) disputing the claims regarding the Mitigating Issue, provided you must have used reasonable and good faith efforts to try to remedy the Mitigating Issue with the Greenfinger prior to disputing the Mitigating Issue claim.

 

5. General Provisions

 

5.1 No Assignment/No Insurance. This Greenfinger Refund Policy is not intended to constitute an offer to insure, does not constitute insurance or an insurance contract, does not take the place of insurance obtained or obtainable by the Greenfinger, and the Greenfinger has not paid any premium in respect of the Greenfinger Refund Policy. The benefits provided under this Greenfinger Refund Policy are not assignable or transferable by you.

 

5.2 Modification or Termination. AllotMe reserves the right to modify or terminate this Greenfinger Refund Policy, at any time, in its sole discretion. If AllotMe modifies this Greenfinger Refund Policy, we will post the modification on the AllotMe Platform or provide you with notice of the modification and AllotMe will continue to process all claims for Mitigating Issues made prior to the effective date of the modification.

 

5.3 Entire Agreement. This Greenfinger Refund Policy constitutes the entire and exclusive understanding and agreement between AllotMe and you regarding the Greenfinger Refund Policy and supersedes and replaces any and all prior oral or written understandings or agreements between AllotMe and you regarding the Greenfinger Refund Policy.
